LEERDERGEDRAGSKODE

Dit is ons strewe om by Laerskool Malelane ‘n omgewing daar te stel waar elke leerling gelukkig sal wees. Hier moet hy/sy geleenthede benut om in totaliteit te ontwikkel.

Elke leerling se akademiese vordering bly ‘n prioriteit. Hier by die skool versterk ons waardes en normes wat elke kind by die huis as opvoeding ontvang. Ons streef daarna dat elke leerling sy positiewe menswees uitleef.

Die gedragskode word gegrond op die volgende:

  1. Dissipline en orde is die hoeksteen van ‘n suksesvolle samelewing.
  1. Dissipline moet hoogste prioritieit geniet.
  1. Implementering van sanksies geskied volgens die leerdergedragkode en met die volle samewerking en kennisname van die ouers.
  1. Die ouerhuis en skool dien dieselfde doel, nl. die opvoeding van die kind sodat hy/sy na behoorlike volwassenheid begelei kan word.
  1. Wedersydse respek en agting tussen alle partye is noodsaaklik en ‘n kultuur van verdraagsaamheid is ‘n belangrike uitganspunt.
  1. Die leerdergedragskode is onderworpe aan die Grondwet van Suid-Afrika 1996 (Wet nr 108 van 1996) en die SA skolewet van 1996 (Wet nr 84 van 1996).
  1. Die skool poog daarna om gedissiplineerd op te tree.
  1. Die beste dissipline is selfdissipline en die samewerking van elke leerder, ouer en onderwyser word vriendelik gevra.
  1. Van elke leerder word verwag om ‘n hoë morele en etiese standaard van optrede, gedrag en taalgebruik te handhaaf.

2.2 LAERSKOOL MALELANE DISSIPLINêRE BELEID

Soos opgestel deur die Laerskool Malelane Beheerliggaam.

In oorleg met Bestuurspan – Opvoeders – Leerders – Ouers.

Die Gedragskode is opgestel volgens voorskrifte in:

  1. Die Grondwet van die Republiek van Suid-Afrika 1996.
  2. Suid-Afrikaanse Skolewet van 2006
  3. Riglyne vir ‘n Gedragskode vir leerders
  4. Gedragskode vir Leerders. Saamgestel in opdrag van SASOO deur SOORB.

NIKS SAL ‘N LEERDER DAARVAN VRYSTEL OM AAN DIE GEDRAGSKODE EN SKOOLREëLS VAN DIE SKOOL GEHOOR TE GEE NIE.

  1. Die LSM Gedragskode is in die Dissiplinêre beleid opgeneem en word daarvolgens toegepas in die praktyk.
  1. Daaglikse program
    • Aantree by saal
  • Maandae vind opening in die saal plaas of soos deur die hoof bepaal. Klasse tree aan op die aantreeblad onder toesig van opvoeders.
  • Daar heers absolute stilte wanneer die leerders die saal binnestap.
  • Elkeen gedra hom/haar eerbiedig vir die saalgeleentheid.
  • Wanneer die volkslied/skoollied gesing word, staan almal op aandag.
  • Toegang
  • Geen leerders mag die ontvangslokaal of saal as deurgang gebruik nie.
  • Leerders beweeg slegs deur die ontvangslokaal indien hulle die sekretaresse moet gaan spreek.
  • Die personeelkamer is ook buite perke, behalwe wanneer ‘n leerder daarheen gestuur/ontbied word.
  • Gedurende pouses word die leerders nie in die klaskamers, saal, of op die stoepe, sonder verlof van ‘n opvoeder toegelaat nie.
  • Gedurende skoolure mag ouers slegs deur die kantoor met leerlinge in verbinding tree.
  • Voor skool en pouses
  • Geen rowwe speletjies mag gespeel word nie. Geen spel of enige ander aktiwiteit mag ‘n gevaar vir enige leerder, insluitend hom/haar inhou nie.
  • Groter leerders mag nie in die spel van kleineres inmeng nie.
  • Daar mag nie naby enige voertuie gespeel word nie. Die motorafdakke is buite perke vir enige leerling.
  • Niemand mag sonder verlof van die skoolhoof of lede van die bestuurspan, die terrein verlaat nie.
  • Die uittekenboek by die kantoor moet geteken word wanneer leerders gedurende skoolure gehaal word.
  • Alle leerlinge moet gedurende pouses op die skoolterrein bly en op die plekke speel soos aan hulle uitgewys/aangewys.
  • Wanneer die klok lui vir die einde van pouse moet leerders ophou speel en so gou moontlik aantree buite hulle klasse vir die volgende periode.
  • Geen kougom is op enige tyd toelaatbaar nie, hetsy binne of buite die klaskamer of op die sportveld.
  • Wanneer pouses aanbreek, plaas leerlinge hulle tasse by die klas waar hulle na pouse moet wees.
  • Geen vuil taal of teken mag gebruik word nie.
  • Afwesighede
  • Leerlinge mag slegs weens siekte of om ‘n ander grondige rede van die skool afwesig wees.
  • ‘n Leerling wat afwesig was, moet op die eerste dag wat hy weer die skool besoek ‘n brief van sy/haar ouers/voog bring, waar ‘n rede vir afwesigheid verskaf word.
  • Indien ‘n leerder langer as twee dae afwesig is, moet ‘n doktersbrief ingehandig word.
  • Dis die leerder se persoonlike verantwoordelikheid om verlore werk na afwesigheid so gou moontlik in te haal.
  • Leerders wat afwesig is, moet werk wat gemis is, self opvang deur dit by ‘n maat te kry, of dit die eerste dag wat die leerling weer terug is by die skool, by die onderskeie onderwysers te kry.
  • Leerders wat gedurende die skooldag afwesig is, sonder ‘n wettige verskoning, sal nie dieselfde middag toegelaat word om aan sport/kultuurbyeenkomste/wedstryde deel te neem nie.
  • Selfone, i-pods, MP3 spelers en Elektroniese horlosies
  • Geen van bogenoemde mag gedurende skoolure, insluitend pouses, aangeskakel wees nie.
  • Bogenoemde is ook die kind se eie verantwoordelikheid. Indien dit gesteel/verlore/beskadig raak, kan die skool nie vir verlies verantwoordelik gehou word nie.
  • Gedrag op terrein
  • Leerders moet opstaan en hul opvoeders en ander volwassenes groet wanneer hulle verbyloop.
  • Niemand mag in die privaat eiendom van ander krap, daarmee peuter en/of dit gebruik sonder die eienaar se toestemming. ( Opvoeders of gemagtigde persone wat ongeoorloofde eiendom soek, sal nie deur die reël aan bande gelê word nie )
  • Leerders mag nie met die terreinwerkers en/of terreinbestuurder geselsies aanknoop nie.
  • Geen leerder mag enige besoeker op die skoolterrein of by die hekke of die omheining te woord staan tydens pouses of in skoolure nie.
  • Hekke
  • Die hek by die paviljoen, die hek naby tydelike klaskamer en die klein hekkie by die saal word om 7h25 gesluit. Die hoofhek by die kantoor sal egter gedurende skoolure met die nodige toegangsbeheer, oop wees.
  • Hekke word weer oopgesluit aan die einde van die skooldag.
  • Ouers word versoek om nie voor klaskamers saam te drom nie aangesien dit die klasdissipline beïnvloed.
  1. Voorkoms
  • Skooldrag
  • Die voorgeskrewe skooldrag moet gedurende skoolure en ander aktiwiteite/funksies, soos deur die Beheerliggaam bepaal, gedra word.
  • Wintersdrag, is met die toestemming van die Bestuurspan, in die somer toelaatbaar, maar in die winter verpligtend.
  • Geen vermenging van somers-en wintersdrag is toelaatbaar nie. ‘n Trui of skoolsweetpakbaadjie kan wel in die somer gedra word na gelang van die weersomstandighede.
  • Die Bestuurspan mag volgens sy diskresie, toestemming verleen dat leerlinge gewone/siviele klere/nie-skooldrag aantrek tydens sekere geleenthede. By so ‘n geleentheid moet leerlinge behoorlik, ordentlik en welvoeglik aangetrek wees.

  • Sportdrag
  • Die voorgeskrewe sportdrag moet gedurende aktiwiteite/funksies, soos deur die Beheerligaam bepaal, gedra word.
  • Elke sportsoort se voorgeskrewe kleredrag moet streng nagevolg word.

  • Geen vermenging van sportsoorte se sportdrag is toelaatbaar nie.
  • Wanneer leerders op wedstryddae die skool in sportdrag bywoon, moet hulle netjies daarin geklee wees.

  • Persoonlike netheid (Voorkoms)
  • Leerders van Laerskool Malelane sal ten alle tye ‘n netjiese voorkoms handhaaf soos deur die beleid bepaal.

  1. In die klaskamer
  • Gedrag en Optrede
  • Leerders moet betyds aanmeld en vir die volle duur van die skooldag by die skool teenwoordig wees.
  • Elke leerling moet sy/haar uiterste bes doen om die orde te handhaaf en sy/haar deel doen sodat die werk so vining moontlik kan vlot en geen ontwrigting veroorsaak word nie.
  • Leerders staan buite die klaskamer totdat hulle beveel word om in te stap. Hulle bly staan totdat die opvoeder hulle vra om te sit.
  • Opdragte deur opvoeders moet stiptelik en sonder uitsondering uitgevoer word.
  • Klasreëls, wat in ooreenstemming met hierdie gedragskode en skoolreëls is, moet verskyn in elke klas. Oortreding daarvan is so goed soos die oortreding van hierdie Gedragskode en skoolreëls.
  • Niemand mag so optree dat ‘n ander se menswaardigheid gekrenk word nie. Dissiplinering beteken nie dat die getugtigde se menswaardigheid aangetas word nie.
  • Slegs boeksakke wat behoorlike beskerming aan boeke verleen is toelaatbaar. Geen slagspreuke of enige gekrap word op boeksakke toegelaat nie.
  • Alle boeke moet oorgetrek word soos deur die onderwyser voorgeskryf. Boeke moet netjies gehou en opgepas word. Beskadigde en verlore boeke sal deur die ouers vervang word.
  • Leerders mag slegs die klaskamer met toestemming van die betrokke onderwyser verlaat.
  • Leerders ontmoet hulle ouers na skool buite die skoolterrein en word dus nie by die klaskamers deur ouers ingewag nie. Uitsondering met Gr A en 1 leerlinge!
  • Akademie
  • Elke leerling moet in besit wees van ‘n dagboek waarin alle huiswerk en boodskappe aan ouers van persoonlike aard aangeteken word.
  • Alle huiswerk moet stiptelik voltooi word. Verskonings moet skriftelik deur die ouers gemaak word.
  • Werk wat deur die ouers onderteken moet word, moet so spoedig moontlik na uitdeling, terug wees by die skool.
  1. Buite die klaskamer
  • Geboue en terrein

Leerlinge moet ten alle tye die nodige eerbied en respek teenoor die geboue, toerusting en klaskamers betoon.

Geen rommelstrooi, van enige aard, is toelaatbaar in en om die skoolterrein nie.

Daar sal van die leerlinge verwag word om die Fauna en Flora op die terrein te beskerm en te bewaar.

  • Sport-, Kultuur en Skoolbetrokkenheid
  • Daar word van elke leerling verwag om met sy/haar talente op die kultuurakker en sportveld te woeker.
  • Leerlinge moet betyds wees vir buitemuurse aktiwiteite.
  • Leerlinge wat nie aan buitemuurse aktiwiteite deelneem nie, mag onder geen omstandighede op die skoolterrein ronddrentel nie. Dit geld ook vir leerlinge wat wag om aan hulle aktiwiteite deel te neem, of leerlinge wat se aktiwiteite reeds afgehandel is. Dit voorkom ongeruimdhede.
  • Indien ‘n leerling nie by sy/haar buitemuurse aktiwiteite betrokke kan wees nie, moet sy/hy, betyds by die onderskeie afrigters verskoning maak.
  • Verkeersreëls
  • Leerlinge sal ten alle tye in en om die skool verkeersreëls nakom.
  • Geen leerling sal met sy/haar fiets op die skoolterrein ry nie.
  • Gedrag van leerlinge teenoor personeel
  • Leerlinge moet hulle onderwysers beskou as hulle leermeesters en raadgewers. Mense wat altyd bereid sal wees om aan hulle leiding te gee.
  • Leerlinge moet die gesag van die onderwysers aanvaar en hulle met respek behandel.
  • Gedrag en optrede van leerlinge
  • Ons sien op na ons seniors om goeie orde, gees en die tradisie van ons skool na te kom. Van alle leerlinge word verwag om mekaar onderling te ondersteun en aan te moedig op verskillende terreine van die skoollewe.
  • Leerlinge moet hulle altyd en oral so gedra dat die goeie naam van die skool hoog gehou word.
  • Leerlinge moet die skoolleiers te alle tye gehoorsaam, hulle gesag aanvaar en hulle met respek behandel.
  • Besering of siekte tydens skoolure
  • Indien ‘n leerling gedurende skoolure beseer of siek word, moet dit onmiddellik by die kantoor aangemeld word.
  • So ‘n leerling mag, slegs met die ouers se toestemming, by die skool gehaal word deur iemand anders indien dit nie die wettige ouer of voog is nie.
  • Die persoon wat ‘n siek / beseerde leerling huistoe neem moet sodanige leerling in die ‘Uittekenboek’ in die kantoor uitteken.
  • Geen leerling mag self huis toe bel wanneer hy/sy siek is nie. Dit word deur die kantoorpersoneel/betrokke onderwyser gedoen.
  • Leerders word slegs met ‘n brief na die siekekamer gestuur.
  • Leerders kan slegs medikasie ontvang met skriftelike/telefoniese toestemming van die ouers.
  • Indien ‘n leerder ernstig beseer is, sal die ouers onmiddelik in kennis gestel word en die nodige mediese hulpverlening sal deur opgeleide personeel toegepas word.
  • Klaswisseling
  • Gedurende klaswisseling beweeg die leerlinge flink in enkelgelid rye na die volgende klas.
  • Leerlinge hou links om klaswisseling te bespoedig.
  • Personeel moet tydens klaswisseling buite hulle klasse stelling inneem om dissipline te handhaaf en te verseker dat wisseling flink en ordelik geskied.
  • Geen leerling mag tydens klaswisseling die badkamer besoek nie. Leerlinge moet eers by die betrokke klas aanmeld en toestemming verkry by die betrokke onderwyser. Dit voorkom ongeruimdhede.
  1. “SIEN-MY-RAAK” DISSIPLINE STELSEL

Die dissiplinêre stelsel is daarop gemik om leerlinge sinvol te dissiplineer, sekere gedragstendense te identifiseer en ook om rekord te hou van leerlinge se gedrag.

  1. Kategorieë van oortredings
  • Kategorie 1

Hierdie kategorie is daarop gemik om goeie akademiese prestasies te lewer. Dit is ook daar om ‘n netjiese voorkoms te bevorder vir ‘n goeie selfbeeld, trots en lojaliteit teenoor die instelling en selfdissipline.

Kategorie 1 (1 punt)

  1. Kleredrag en netheid nie volgens die LSM klerebeleid nie
  2. Huiswerk afskryf by maats / boeke uitleen / huiswerk nie in dagboek geskryf / pligversuim/ slordige werk/ onvolledige werk
  3. Laat by klas tydens wisseling of na pouses
  4. Huiswerk nie gedoen nie
  5. Eet/drink in klas / kougom kou op skoolterrein of by enige sportbyeenkomste
    • Kategorie 2

Hierdie is “minder ernstige” oortredings, waar die leerling se wangedrag homself en andere in die skool en die speelgrond benadeel t.o.v. ordelikheid en bedagsaamheid.

Kategorie 2 (2 punte)

  1. Ongemanierdheid / aanhoudende gesels
  2. Huiswerk nie gedoen / boeke nie by die skool nie / boeke / handboeke verloor

(Handboeke en skrifte wat weg of beskadig is moet op die leerder se onkoste vervang word).

  1. Oneerlikheid / Leuens
  2. Dagboek nie by die skool nie.
  • Kategorie 3

Hierdie kategorie is gemik op algemene gedrag wat sinvolle onderrig kan belemmer. Dit sluit in leerlinge se algemene gedrag teenoor mede-leerlinge en personeel.

Kategorie 3 (5 punte)

  1. Indoktrinasie /die negatiewe beïnvloeding van maats
  2. Viktimisasie/teistering / baklei / boelie – verbaal of fisies
  3. Graffiti – skryf/teken op enige meubels, geboue of skooleiendom
  4. Stokkiesdraai
  5. Enige optrede wat skool se naam en beeld oneer aandoen en die gedragskode teenstaan tydens enige skoolbyeenkoms.
  6. Indien selfoon gedurende skooltyd sigbaar is en/of gebruik word, word die foon ook gekonfiskeer en ‘n boete van R50.00 moet betaal word om dit terug te kry.
  7. Minagtende / disrespekvolle optrede teenoor personeel / terugpraat.
  8. Gekleurde en vreemde haarstyle – selfs nie om luise te beheer nie.
  9. Ontoelaatbare taalgebruik / vloek

1.4 Kategorie 4 ( 10 punte )

Hierdie meer ‘ernstige’ oortredings sluit gevaarlike, immorele en ernstige anti-sosiale gedrag by leerlinge in.

Kategorie 4 (10punte)

  1. Rook/in teenwoordigheid van rokers/besit van sigarette.
  2. Diefstal/besit van gesteelde goedere.
  3. Ernstige aanranding/fisiese geweld.
  4. In besit van/gebruik van dwelms.
  5. Besit/inbring/gebruik van alkohol.
  6. Besit en versprei van pornografiese of onwelvoeglike materiaal – enige media.
  7. Ernstige vandalisme/saakbeskadiging.
  8. Seksuele of onsedelike gedrag / onwelvoeglikheid.
  9. Eksamen/toets-onreëlmatighede.
  10. Rassehaat/haatspraak
  11. Besit of gebruik van gevaarlike wapens (skerp voorwerpe, messe, naalde, ens.)
  12. Enige optrede wat die lewe of veiligheid van ander in gevaar stel / klippe gooi.
  13. Verontagsaming van dissiplinêre optrede of straf wat opgelê is / wegbly van detensie sonder verskoning.
  14. Medepligtigheid aan die pleging van enige van die bogenoemde oortredings.
  15. Bogenoemde wangedrag gepleeg tydens enige skoolfunksie of uitstappie al is dit buite skoolure.
  1. Hanteringsprosedure
  • Kategorie 1, 2 en 3.

OPTREDE TEN OPSIGTE VAN OORTREDING

JUNIORS

  1. Verlore dagboeke moet dadelik vervang word teen R100
  2. Personeellid skryf oortreding in dagboek / dissiplinêre joernaal
  3. Na 5 punte ontvang ouers ‘n waarskuwingsbrief vanaf Departementshoof.
  4. 10 punte. Leerder sal detensie sit Vrydae 14:00 – 16:00 soos gereël met ouers.

SENIORS

  1. Verlore dagboeke moet dadelik vervang word teen R100
  2. Personeellid skryf oortreding in dagboek / dissiplinêre joernaal
  3. Na 10 punte ontvang ouers ‘n detensiebrief en sms vanaf Departementshoof.
  4. Leerder sal detensie sit Vrydae 14:00 – 16:00 soos gereël met ouers.
  • Kategorie 4
  • Ouers word onmiddellik telefonies in kennis gestel.
  • Onmiddellike detensie. Leerder sal detensie sit Vrydae 14:00 – 16:00 soos gereël met ouers.
  • Onmiddelike opskorting van skoolbywoning
  1. Strafmaatreëls
  • Detensie
  • Indien ‘n leerling 10 of meer punte het, ontvang die ouer/voog ‘n detensie skrywe en SMS met die daaropvolgende detensiedatum en tyd.
  • Detensie vind op Vrydae-middae plaas, in ‘n lokaal, soos vooraf gereël.
  • Detensie duur van 14:00 tot 16:00
  • Geen leerling sal voor die tyd verskoon word nie.
  • Indien ‘n leerling nie die detensie kan bywoon nie, moet die ouer/voog, die skool skriftelik in kennis stel.
  • In so ‘n geval sal die leerling die daarop volgende week se Vrydag detensie sit.
  • Leerlinge wat sonder verskoning wegbly van die detensie, se ouers word gekontak en die leerling met sy/haar ouers sal in ‘n dissiplinêre verhoor insit soos deur die Bestuur van die skool bepaal word.
  • Op Vrydae-middae sal die leerlinge van uitskryfwerk voorsien word.
  • Punte val weg vanaf die datum wat die detensie toegeken is. Bv, as die detensie op 27/2 toegeken is, val oortredings voor 27/2 weg. Oortredings daarna tel weer punte op soos normaal.
  • Punte word nie oorgedra van een kwartaal na die volgende kwartaal nie.
    • Leiers
  • Skoolleiers wat hulle skuldig maak aan oortredings sal die volgende strawwe opgelê word:
  • Die leier sal die detensie bywoon indien hy die totaal van 10 punte bereik.
  • Indien ‘n leier vir ‘n tweede maal detensie moet sit, sal sy balkie dan vir ‘n tydperk van een week van hom af weggeneem word.
  • Indien ‘n leier vir ‘n derde keer moet detensie bywoon, sal sy ouers in kennis gestel word. Die normale strafprosedure waar die leier dan voor die tugkomitee moet verskyn sal dan volg, waarop die tugkomitee dan sal besluit op ‘n gepaste straf.
  • Tugverhoor
  • Tydelike opskorting van klasbywoning/buitemuurs
  • Indien ‘n leerling ‘n derde keer detensie ontvang, sal die ouers telefonies en skriftelik in kennis gestel word. Die leerling sal dan vir een skooldag geskors word.
  • Indien die leerling ‘n verdere detensie (4) ontvang, sal die ouers weer in kennis gestel word en sal die leerling vir twee skooldae geskors word.
  • Indien die leerling ‘n verdere detensie (5) ontvang, sal die ouers in kennis gestel word en die leerling vir vyf skooldae geskors word.
  • Indien die leerling weer ‘n detensie (6) ontvang, sal die ouers in kennis gestel word. Die leerling en ouers sal dan voor ‘n tugkomitee verskyn soos voorgeskryf deur die SA Skolewet van 2006. Die tugkomitee sal dan strafmaatreëls toepas soos uiteengesit deur die SA Skolewet van 2006.
  • Aansoek om uitsetting

Opsie 3.3.1.3 en 3.3.1.4 sal slegs oorweeg word indien dit blyk dat die leerling nie positief reageer op ander strafmaatreëls nie. Dit sal voorafgegaan word deur ‘n proses van uitgebreide onderhandelinge met alle betrokke partye en in ooreenstemming met die bepalings van die S.A. Skolewet en alle ander statutêre bepalings.

  • Tugkomitee

‘n Tugkomitee sal deur die beheerliggaam aangewys word om ‘n tugverhoor te lei.

  1. Oortredings wat tot skorsing en uitsetting mag lei.

Sou dit blyk dat ‘n leerling nie positief reageer op strafmaatreëls nie, kan daar oorgegaan word tot tydelike skorsing van die bywoon van klasse en/of ander skoolbedrywighede en die uiteindelike skorsing, ooreenkomstig volgens die bepalings van die SA Skolewet van 2006. Hieroor sal die Bestuurspan/Tugkomitee besluit.

Die volgende strafmaatreëls mag toegepas word:

  1. Berading met leerder
  2. Waarskuwing
  3. Berading met ouers
  4. Finale waarskuwing
  5. Herstel van skade
  6. Akademiese strafwerk
  7. Tydelike uitsetting
  8. Ontneem van skoolaktiwiteite bv. Gr 7 afsluiting/sport/sokkies ens.
  9. Strawwe soos bepaal deur die Tugkomitee. Na herhaaldelike beradingsessies en waarskuwings mag permanente uitsluiting van toepassing wees.
  1. Kommunikasiekanale, grieweprosedure en behoorlike regsproses

Alle opvoeders by die skool sal oor dieselfde regte as die ouer beskik om ‘n leerling in gevolge hierdie Gedragskode en Skoolreëls te beheer en te dissiplineer gedurende die tyd wat die leerling in die skool, asook enige klas, skoolfunksie, skooluitstappie of skoolverwante aktiwiteite bywoon.

Die SA Skolewet en hierdie gedragskode bemagtig skoolowerhede om leerlinge te dissiplineer, maar dit is buite die Wet en Gedragskode om hierdie bevoegdheid aan medeleerders te delegeer. Leerlinge is vennote met ander leerlinge en kan slegs in toesighoudende kapasiteit/ampte aangewend word, want hulle is nie as sulks in beheer van die skool nie.

  1. Kommunikasie en grieweprosedure
  • Enige leerder of ouer/voog het namens die leerder wat gegrief voel oor die optrede deur ‘n ander leerder, ‘n opvoeder of enige ander persoon verbonde aan die skool, die reg om sy/haar grief te lug deur na die betrokke Departementshoof te gaan.
  • Die betrokke DH sal dan probeer om die probleem intern op te los, of te verwys na die adjunkhoof. Hiervandaan volg die normale lynfunksie.
  • Indien ‘n leerling voel dat hy/sy onregverdig of verkeerdelik behandel is deur ‘n opvoeder of Departementshoof, het hy/sy die reg tot appèl, direk na die skoolhoof met of sonder die tussenkoms van sy ouers.
  • Indien die saak nog nie opgelos is nie, mag hy/sy die saak by die Voorsitter van die Beheerliggaam, deur die tussenkoms van sy/haar ouers, aanmeld.
  • In uiterste gevalle, waar die saak nie intern opgelos kan word nie, mag daar geappèlleer word na die Onderwysdepartement, en wel deur gebruik te maak van hul eiesoortige lynfunksie.
  • Net die hoofseun/hoofdogter tesame met die leiervoog mag die hoof nader vir ‘n vreedsame samekoms van leerlinge om ‘n saak van gemeenskaplike belang te bespreek. Alle besluite geneem tydens so ‘n byeenkoms, moet met die tussenkoms van die hoof, direk na die Beheerliggaam vir ‘n finale beslissing verwys word.
  • Alle besluite geneem op ‘n leerlingvergadering word na die Bestuurspan verwys vir die finale beslissing en/of na die Beheerliggaam.
  • Ouers word versoek om die lynfunksie te volg, maar het altyd die reg om die hoof direk te kontak en ‘n saak met hom te bespreek indien hy beskikbaar is.

    • Maak ‘n afspraak om die betrokke departementshoof te sien, na amptelike skoolure.
  • Indien daar nog steeds nie tot ‘n ooreenkoms gekom kan word nie:
    • Sal die saak na die betrokke adjunkhoof/hoof verwys word.
  1. Indien ‘n leerling ‘n probleem ondervind
  • Neem die probleem met die betrokke personeellid op.
  • Indien daar nie tot ‘n ooreenkoms gekom kan word nie, kan die leerling die saak met die betrokke departementshoof opneem.
  • Indien daar nog steeds nie tot ‘n ooreenkoms gekom kan word nie, kan die prosedure gevolg word soos uiteengesit in 4.2 en 4.3.
  1. Sosiale media/gedrukte media

Leerders/ouers onderneem om hulle te weerhou van die plasing van lasterlike bewerings, of enige vorm van haatspraak teenoor, of in verband met ander leerders, of onderwysers op enige vorm van sosiale media, of gedrukte media en onderwerp hulle aan die beleid en prosedure soos vervat in hierdie dissiplinêre beleid by oortreding van bogenoemde onderneming.

  • ‘n Opbouende sisteem waarmee positiewe gedrag beloon sal word, sal daar gestel word ter motivering.


LEARNER CODE OF CONDUCT

It is our aim at Laerskool Malelane to set an environment where every learner will be content. Here he/she must use every opportunity in order for holistic development to take place.

The Academic progress of each learner remains a priority. At school we strengthen the values and norms of each child which were received at home as part of a proper upbringing. We strive towards creating an opportunity for each child to live out his/her positive humanity.

The Code of Conduct is based on the following:

  1. Discipline and order are the corner stone of a successful community.
  1. Discipline must have the highest priority.
  1. Implementation of sanctions according to the disciplinary code with the full co-operation and knowledge of the parents.
  1. Both the parenting structure and the school serves the same purpose, i.e. the education of a child in order to lead a child towards optimal maturity.
  1. Mutual respect among all stake holders and a culture of tolerance is very important.
  1. The Learner Code of Conduct is in accordance with the Constitution of South Africa 1996 (Law no 108 of 1996) and the South African Schools Act 0f 1996 (Law no 84 of 1996).
  1. The school strives towards acting in a disciplined manner.
  1. The best discipline is self-discipline and the co-operation of each learner, parent and teacher is required.

  1. We expect all leaners to uphold high moral and ethical values in all actions, behaviour and language at all times.

2.2 LAERSKOOL MALELANE DISCIPLINARY POLICY

As composed by the Laerskool Malelane Governing Body.

In conjunction with the Management Team – Educators – Learners – Parents.

The Code of Conduct was set in accordance with:

  1. The Constitution of South Africa 1996.
  2. South African Schools Act of 2006.
  3. Guidelines for a Code of Conduct for Learners.
  4. “Gedragskode vir Leerders. Saamgestel in opdrag van SASOO deur SOORB.”

NOTHING WILL GRANT A CHILD THE RIGHT NOT TO ADHERE TO THE DISCIPLANARY CODE AND RULES OF THE SCHOOL.

  1. The LSM Code of Conduct is taken up in the Disciplinary Code of the school and will be practised accordingly.

  1. Daily programme
    • Assembly at the hall

  • On Mondays there will be assembly in the hall or as determined by the Principal. Classes gather in the quad under supervision of their Guardian Teachers.
  • Learners will enter the hall in silence.
  • Everybody must behave appropriately for the duration of the assembly.
  • When singing the National Anthem and/or School Anthem all learners will be standing at attention.
  • Admission
  • No learners may use the hall or office as a place of thoroughfare.
  • Learners are only allowed in the office if they need to go to the secretary or SMT member.
  • The Staff Room is also out of bounds, unless a child was summoned or sent by a teacher.
  • Learners are not allowed in classes, the hall, on passages etc. during break, without the permission of a teacher.
  • During school time parents may only communicate with their children through the office.

  • Before school and during breaks

  • No rough games or activities are allowed. No game or action may be dangerous/ harmful towards any other learner, including personal endangerment/ self-harm.
  • Older learners may not interfere with the games of younger learners.
  • No play is allowed near vehicles and the parking area is out of bounds.
  • Nobody may leave the school terrain without the permission of the principal or SMT.
  • If a child is fetched during school hours, parents/ guardians must sign the learners out in the office before leaving the school premises.
  • All learners must stay on the school terrain and in the designated areas during break.
  • Children must stop play immediately when the bell signals the end of break. They must move towards their classes as quick as possible for the class to commence.
  • The chewing of gum is prohibited on the school terrain at all times.
  • At the beginning of break all bags must be placed at the class to be attended after break.
  • No foul language or indecent signs are allowed.
  • Absenteeism

  • Learners are only allowed to be absent due to illness or if there is a legitimate reason.
  • On returning to school a learner must provide the class teacher with a letter from the parent/guardian indicating the reason for being absent.
  • If a learner is absent for more than two days, a letter from a medical practitioner is needed.
  • It is the responsibility of a learner to catch up on the work that was missed.
  • Learners who were absent must get the work either from a classmate or at the subject teacher and then complete it on their own.
  • Learners who are absent from school will not be allowed to participate in a sporting/ cultural event during the afternoon.
  • Cell phones, I-pods and MP3 players, electronic (SMART) watches
  • None of the above may be switched on during school hours, including breaks.
  • These devices are also the responsibility of the learners. If it gets lost/stolen/damaged, the school will not take any responsibility.
  • Cell phones etc. must be preferably handed in at the office. A cell phone which is used, seen or rings will be confiscated and a fine of R50.00 will be payable in order to get it back.
  • Conduct on the school terrain
  • It is appropriate for learners to get up and greet teachers / adults when they walk pass them on the terrain.
  • Nobody may tamper with, take or use the private property of someone else without prior permission of that person. (Educators or authorised people looking for prohibited substances/objects will not be hampered by this rule.)
  • Learners are advised not to make idle conversation with the support staff members.
  • No learner may address any visitor during breaks or school hours at the fence or gates.
  • Gates

  • The gates at the pavilion, behind the temporary classroom and next to the hall, will be locked at 07:25. The main gate at the office will be open with the necessary access control during school hours.
  • Gates will be unlocked at the end of the school day according to arrangements.
  • Parents are requested not to wait in front of the classrooms as this is distracting the learners’ attention.
  1. Appearance
  • School uniform
  • The prescribed uniform must be worn during school hours and to activities/ functions, as determined by the SGB.
  • Winter wear is permissible, with the approval of the SMT, during the summer, but it is compulsory during winter.
  • Learners are not allowed to “mix-and-match” different sets of school attire. A jersey or tracksuit top can be worn during summer in accordance with the weather.
  • The SMT may give permission for civvies to be worn on special occasions. It is important that learners are dressed properly and socially acceptable on these days.

  • Sport wear
  • Prescribed sport attire (as determined by the SGB) must be worn during sporting activities.
  • Every sporting code must follow the rules.

  • Learners may not mix and match the sport attire of different sporting codes.
  • If learners come to school in sporting attire on game days, it must be neat.

  • Personal neatness (Appearance)

  • Learners of Laerskool Malelane will uphold a neat appearance at all times according to policy.

  1. In the classroom

  • Conduct and behaviour

  • Learners must arrive in time and stay at school for the whole day.
  • Each individual must do his/her utmost best to maintain order so that work can be completed efficiently and in as little time as possible, without causing any disruptions.
  • Learners are supposed to stand in line in front of the classes until given permission to enter. They remain standing behind their chairs until the educator asks them to sit down.
  • Instructions from educators must be adhered to timeously and without hesitation.
  • Class rules, set in accordance with the Code of Conduct and General School Rules, must be set and displayed in class. Non-adherence thereof is as if it is a transgression of this Code of Conduct.
  • No one’s actions may have a negative effect on the humanity of someone else. Disciplining someone does not mean that a person can be belittled.
  • Only school bags providing proper protection for books may be used. No slogans or graffiti will be allowed on bags.
  • All books must be covered according to instruction from the subject teacher. Books must remain neat and well-kept. Damaged and missing books must be replaced by the parents.
  • Learners may only leave a classroom with proper permission from the teacher.
  • Learners are supposed to meet their parents outside the school terrain and parents are not supposed to wait in front of classes. A specific arrangement will be made with Gr. R and 1 parents.
  • Academics

  • Every learner must be in possession of a homework book in which all homework and correspondence from parents must be written.
  • All homework must be completed. If there is a valid reason for not complying, parents must provide it in writing.
  • Parents must ensure that they sign work off timeously when needed.
  1. Outside the classroom

  • Buildings and Terrain

Learners must at all times show respect towards buildings, equipment and class rooms.

No littering, of any kind, is permissible in and around the school terrain/grounds.

It will be expected from children to conserve the Fauna and Flora on the school terrain.

  • Sport, Culture and School Involvement

  • All learners are expected to use and develop their talents on both sport and cultural level.
  • Learners must be in time for extra-mural activities.
  • Learners, who do not participate in extra-mural activities, are not allowed to loiter around on the school grounds. This is also applicable to learners who are done and/or waiting for their activities to commence.
  • If a learner cannot attend his/her extra mural activity the coach/teacher must be informed in time.
  • Traffic rules

  • Learners must adhere to all traffic rules in and around the school.
  • No learner is allowed to ride a bicycle on the school terrain.
  • Conduct of learners towards staff members

  • Learners must see educators as their teachers and mentors who are always willing to give proper guidance.
  • Learners must accept the authority of teachers and treat them with respect.

  • Behaviour and Conduct of Learners

  • We are depending on our seniors to uphold order, spirit and traditions of the school. It is expected of all learners to support and motivate one another with all aspects of school life.
  • Learners must behave in such a way that they will always be ambassadors of the school.
  • School leaders must be treated with respect. They should be listened to and their authority must be accepted.
  • Injury or illness during school hours

  • If a learner gets injured or falls ill during school hours, it must be reported to the office as soon as possible.
  • A learner may only be taken from school by the legal parent or someone the parent has given permission to, after informing the school of such permission.
  • The person taking the sick/injured child home must sign the register in the front office.
  • No learner is allowed to phone home in person. It must be done through the office by a staff member.
  • Learners are sent to the sick bay with a letter of approval.
  • Administering of medicine may only be done with the consent of parents.
  • If the injury is serious, the parents will be informed and the necessary aid will be given by a professional.
  • Class rotation

  • Children must walk briskly to the next class in single file.
  • Learners must keep to the left to minimise congestion.
  • Staff members must be outside their classes to maintain discipline and to ensure that the change of classes is fast and efficient.
  • No learner may go to the bathroom during the change of classes. They have to report at class and get permission. This minimizes problems.
  1. “ACKNOWLEDGE ME” DISCIPLINARY SYSTEM

The disciplinary system aims to discipline learners in a positive way. It helps with the identification of certain behavioural patterns and to keep a record of a learner’s conduct.

  1. Offence Categories

  • Category 1

This category aims to deliver better academic achievement. It also has the purpose of instilling a neat appearance, which in turn helps with the development of a proper self-esteem, pride and loyalty towards the institution as well as self-discipline.

Category 1 (1 debit)

  1. Attire and appearance in contradiction with school policy.
  2. Copying of homework/lending books to copy from/homework not written down in diary/ negligence.
  3. Coming late to class after break or change of classes.
  4. Homework incomplete.
  5. Eating/Drinking in class/ Chewing gum on the school terrain or at any sport event.
    • Category 2

These are less serious misdemeanours where the misconduct of a learner has a negative influence on him/herself and other learners of the school with regard to being orderly and courteous.

Category 2 (2 debits)

  1. Ill-mannered/ Constant talking
  2. Homework not done/books not at school/lost books or textbooks

(Lost and misplaced books and textbooks must be replaced at the cost of the learner)

  1. Dishonesty/ Telling lies.
  2. Diary not at school. (Lost diaries must be replaced at a cost of R100)
  3. Coming late to school without an acceptable excuse. Constant late coming because of public transport.
  • Category 3

This category addresses general behaviour which might have a negative impact on teaching and learning. This includes general behaviour towards both learners and teachers.

Category 3 (5 debits)

  1. Indoctrination/ negative influence on peers.
  2. Victimisation/harassment / fighting / bullying – verbal or physical.
  3. Graffiti – writing/drawing on any furniture, buildings or school property.
  4. Bunking classes.
  5. Any behaviour which tarnishes the name and image of the school and is in conflict with the code of conduct during all school related activities.
  6. The use/visibility of a cell phone during school time. The phone will also be confiscated and a fine of R50.00 will be payable in order to get it back.
  7. Arrogant / disrespectful behaviour towards staff members/ back chatting.
  8. Coloured and unacceptable hairstyles – not even to manage lice infestation.
  9. Swearing/ unacceptable language.

1.4 Category 4 (10 debits)

More serious offences, including dangerous, immoral and serious anti-social behaviour acted out by learners.

Category 4 (10 debits)

  1. Smoking/ seen in the presence of smokers/possession of cigarettes.
  2. Theft/ possession of stolen property.
  3. Serious assault/ Violence.
  4. In possession of or use of drugs/illegal substances.
  5. Possession/bringing / use of alcohol.
  6. Possession and or distribution of pornographic or indecent material, all media.
  7. Serious vandalism/ damage to property.
  8. Sexual misconduct or indecent behaviour.
  9. Cheating in exams/tests.
  10. Racism/ hate speech
  11. Possession and or use of dangerous weapons (including sharp objects, knives, needles etc.)
  12. Any action endangering the life or safety of another person/ stone throwing
  13. Not adhering to disciplinary measures/ staying away from detention without prior arrangement.
  14. Being an accessory to any of the above transgressions.
  15. All of the above is also applicable during all school activities and excursions, even outside normal school hours.
  1. Handling Procedure

  • Category 1, 2 and 3.

PROCEDURAL ACTION IN REGARDS WITH TRANSGRESSIONS

JUNIORS

  1. Lost diaries must be replaced asap, R100.00 is payable in the office.
  2. Staff member writes transgression in diary/ disciplinary journal.
  3. After 5 debit points the parent will receive a notification from the school.
  4. 10 debit points. Learner will sit detention on Fridays from 14:00 to 16:00 as per arrangement with parents.

SENIORS

  1. Lost diaries must be replaced asap, R100.00 is payable in the office.
  2. Staff member writes transgression in diary/ disciplinary journal.
  3. After 10 debit points parents will receive a detention notification from the school.
  4. Learner will sit detention on Fridays from 14:00 to 16:00 as per arrangement with parents.
  • Category 4
  • Parents will be notified immediately (Telephonically).
  1. Immediate detention. Learner will sit detention on Fridays from 14:00 to 16:00 as per arrangement with parents.
  1. Punishment measures

  • Detention
  • As soon as a learner has more than 10 debit points, parents will be notified with the next detention time and date.
  • Detention will be on Friday afternoons from 14:00 to 16:00 in a classroom as indicated.
  • No learner will be excused before 16:00.
  • If the learner cannot attend detention, the parent must inform the school in writing.
  • In these instance the learner must sit in detention on the following Friday without any excuses.
  • Learners who don’t attend the detention class will be summoned with their parents to attend a disciplinary hearing as determined by the SMT.
  • Learners will be provided with work during the detention class.
  • Debits will fall away from the date on which the detention was given. E.g. If detention was awarded on 27/7, all transgressions before that date will be void. All transgressions thereafter will be counted as usual.
  • Debits will not carry over from one term to the next.
    • School prefects

  • Prefects who are guilty of transgressions will be dealt with as follows:
  • A prefect will sit the normal detention class after acquiring his/her first 10 debit points.
  • If a prefect has to sit a second detention class, his badge will be taken away for one week.
  • If a prefect has to sit a third detention class, his/her parents will be informed and the normal procedure where the said prefect must appear in front of a panel for a disciplinary hearing will be followed, after which the disciplinary committee will decide on an appropriate punishment.
  • Disciplinary hearing

  • Temporary suspension of classes/extra mural activities

  • If a child receives a third detention, parents will be informed telephonically and in writing. The learner will then be suspended for one school day.
  • If another detention (4) is awarded, the parent will once again be informed and the learner will be suspended from school for two days.
  • If another detention (5) is awarded, the parent will once again be informed and the learner will be suspended from school for five days.
  • If another detention (6) is awarded, the parent will be informed. The learner and his/her parents will then have to appear in front of a disciplinary committee as set out in the South African Schools Act (2006). The disciplinary committee will then enforce punitive measures as described in the SA Schools Act of 2006.
  • Application for suspension

Option 3.3.1.3 and 3.3.1.4 will only be considered if a learner does not react positively towards other punitive measures. A due process of negotiation where all stakeholders are involved, and in accordance with the South African Schools Act and other statuary rulings, will be followed.

  • Disciplinary Committee

A disciplinary committee will be appointed by the School Governing Body to conduct the disciplinary process.

  1. Transgressions which may lead to exclusion and expulsion.

If it becomes clear that a learner does not react in a positive manner as a result of punitive measures, it could lead to temporary suspension/ exclusion from classes and/or other school activities, and finally to expulsion according to the guidelines as set in the SA Schools Act of 2006. The SMT /Disciplinary Committee will determine these actions.

The following punitive measures may apply:

  1. Counselling of learner
  2. Warning
  3. Counselling of parent
  4. Final warning
  5. Repair of damages
  6. Additional Academic work
  7. Temporary exclusion/suspension
  8. Not being allowed to participate in school activities, e.g. Tours, fun days, sport, farewells
  9. Punitive measures as determined by the disciplinary committee. After repetitive counselling and warnings, permanent expulsion may be applicable.
  1. Communication, Grievances procedure and due Legislative Process

All educators of LSM will have the same rights as the parent in order to regulate and discipline a learner in accordance with this Code of Conduct and the set school rules while a learner is at school, in class, attending school functions, excursions and any school related activities.

  • The SA Schools Act and this Code of Conduct empowers the School Authorities to discipline learners, but it is outside the Law and Code of Conduct to delegate these responsibilities to co-learners. Learners are in partnership with co-learners and can only be used in a supervising capacity, because they are not, as such, in control of the school.
  1. Communication and Grievances Procedure
  • Any learner or parent/guardian may act on behalf of a learner, who has grievances because of the action of other learners, a teacher or any other staff member connected to the school, by going to the appropriate Head of Department and airing their concern.
  • The HoD will then try to solve the problem or refer it to the Deputy Principal. There after the normal line function will prevail.
  • If a learner feels that he/she has been wrongly accused or been treated inappropriately by any teacher or HoD, he/she has the right to appeal directly towards the Principal, with or without the intervention of his/her parents.
  • If the situation cannot be resolved, the learner may report the situation to the Chairperson of the Governing Body, through the intervention of his/her parents.
  • In extraordinary cases, where the problem cannot be resolved internally, parents may appeal to the Department of Education, and by making use of their set line function.
  • Only the Head Boy/ Head Girl with the prefect guardian may approach the principal to arrange a meeting with learners to discuss a matter of common interest. All decisions taken at such a meeting must be put before the Governing Body for final approval through the intervention of the principal.
  • All decisions taken at a meeting of learners will be decided upon and approved by the SMT and/or SGB
  • Parents are requested to follow the line function, but may contact the principal to discuss a matter, if he is available.
  1. Proper Legal Process

  • Serious misconduct and the Law

Serious misconduct, inclusive of criminal offences, must be reported to the police.

  • Grievance procedure

If a parent has any complaint/enquiry in connection with any teacher/ school related activity:

  • Make an appointment with the teacher in question after formal school hours.
  • If the parties cannot come to an agreement:
    • Hand a written complaint in at school, directed towards the relevant HoD.
    • Make an appointment with the relevant HoD not interfering with his or her classes.
  • If the parties can still not reach an agreement:
    • Matters will be referred to the deputy principal/principal.
  • If a learner experiences problems

  • Take up the problem with the relevant teacher.
  • If no solution is found, take the matter to the relevant HoD.
  • If matters are still not resolved follow the procedures as explained in 4.2 and 4.3.
  • Social Media/ Printed Media

Learners/parents undertake not to make any defamatory accusations, or any form of hate speech, with regard to any learner or teacher on any social media and/or printed media platform. In doing so policy and procedure as stipulated in this Code of conduct/disciplinary policy will come into effect.

  • Positive behaviour
  • A progressive system where positive behaviour will be rewarded will be put in place as means of motivation.
